Section 610 of Public Law 102-395 created the Immigrant Investment Pilot Program, in October 6, 1992. There has been renewed interest in it due to the enforcement of existing immigration laws. Investor Visas: Least complicated way to secure a US Green Card

An EB-5 visa, also referred to as an investor visa, is perhaps one of the least complicated ways to secure a United States Green Card if you are a non-resident. It was established in order to encourage the funneling of foreign capital into the United States economy and also for job creation. This visa grants you permanent US residency on a ‘conditional’ basis with a $1 million dollar investment into your own personal business venture or an already established business created after November 19, 1990. The caveat is that the business must employ at least ten (10) US workers. Another EB-5 visa category is one in which an alien makes an investment of $500,000 into a Regional Center that is designated by the government. After twenty-one (21) months, the investor has the opportunity to apply to have the ‘conditional’ basis removed from his/her green card.

Applying for an EB-5 visa may seem endless. Both the original I-526 and subsequent I-829 immigration USA filings can be complicated, expensive, and long-delayed. USCIS EB-5 Training Materials Released

Under the U.S. Freedom of Information Act (FOIA), petitioners may request internal government materials, which must be released to the public unless there is a compelling governmental interest in not doing so. Recently, a successful FOIA request to USCIS, the immigration USA agency responsible for approving or denying EB-5 visa applications, brought to light almost 500 pages of internal training materials regarding the EB-5 visa program. These materials provide a wealth of new information on how USCIS sees investor visa applications.

With growing backlogs for both H1B green card applicants and people who hope to acquire green cards through family relationships, the EB-5 visa can be an attractive option. This so-called “investor visa” allows foreign nationals to immigrate to the U.S. through investing as little as $500,000 in a qualifying business, with no visa backlogs. However, many EB-5 visa applications have been tripped up on one of the thorniest issues in the practice of investor visa immigration law: proving that the money for the foreign national’s investment came from a “lawful source of funds.”
