Obtaining A Green Card Through Investment
During the Immigration Act of 1990, Congress also created the EB-5 category to both encourage the foreign work flow into the US as well as make jobs for workers in the US. An estimated 3,000 people are interested in the 10 available visas to participate in an EB-5 program specifically designed to target areas of employment.
There are several unique privileges provided with the EB-5, one being that the holder and family members of the EB-5 Visa receive a green card that is “conditional,” meaning it can be removed if applied by the investor twenty-one months from receiving the original green card. When obtaining an EB-5, the recipients and their families are able to live, work, attend school, and do other activities anywhere in the US. The investor is also able to retire from both employment and geographical constraints.
What is Direct Investment on EB5?
Getting an EB-5 Visa is actually quite simple, but it does have some requirements. To invest, the applicant must have invested at least $1 million in their business, or $500,000 if choosing to invest in a designated Regional Center. The investor must also have gained the appropriate capital by law, and allow the business to create at least 10 full time jobs for other workers in the United States. After being issued a Visa, the holder must be in the US within 180 days. Although the EB-5 Visa holder is not required to stay in the US for a certain duration of time, they must show that they intend to become a resident by either opening a bank account, paying taxes, buying or renting a home or getting a social security number and driver’s license.

The Regional Center program was created under the EB-5 pilot program to encourage people to immigrate through the EB-5 category through one of the EB 5 Visa Regional Centers.
