Innovative Immigration To The USA

In 1992, the U.S. Congress created an innovative pilot program that would allow a foreign national, along with his children under age 21 and his wife, to immigrate to this country, get a green card, and make a significant financial investment in a project that would create 10 jobs.

Under the EB-5 visa, or EB5 direct job program, the prospective immigrant is required to put up $500,000 that will be invested in one of the projects offered through one of the regional centers that operate in 24 states in the country.

Stimulating economic activity and job growth were the driving forces behind this congressional program, while at the same time it was aimed at enabling eligible foreign nationals to become lawful permanent citizens of this country.

Under this innovative program, a regional center is defined as an economic unit, public or private, that is engaged in the promotion of economic growth, improved regional economic productivity, job creation and increased domestic capital investment.

The 1992 law required the investment in the regional center to generate an income in export sales. Under amendments in 2000 and 2002, this income-generating requirement in export sales was dropped. Under the EB5 direct job program, the foreign national receiving the direct EB5 visa is not required to actively manage the business where his investment is made. However, if the foreign national, using this investment immigration to USA program, wants to invest in a new or existing business and take an active role in operating one of these businesses in the regional centers, he can, as long as he meets the $500,000 financial requirement.
