How to get an EB-5:
In order to get an EB-5 Green Card you must first file Form I-526. This is stating that you wish to be an immigrant investor. You must file supporting papers that show your investments meet all requirements. You need to show that you can set up a commercial business with the capital amount required and that the capital amount of money you are using comes from a legal source. You must create the proper number of jobs, and be a part of the business as a working member of the establishment. The business must also be set up in an area that has been deprived of employment and has been confirmed as a hard-hit employment area. Meet all these requirements and you may obtain the Conditional Resident EB-5.
After filing the EB-5 petition and being approved, you can file for Conditional Residence by filing Form I-485. This adjusts your status to Conditional Residence.
Once you are a Conditional Resident for a year and nine months, you have to file Form I-829 for Permanent Resident Status. This must be filed before you have been a Conditional Resident for two years. When approved you would be an immigrant investor visa EB-5 Permanent Resident.
What is EB-5 direct investment?
The EB 5 Visa Regional Center is another route to take to live as a Permanent Resident of the U.S. As a direct investor, you, your spouse and children under age 21 would all qualify under the EB-5 direct investment status. Under the EB 5 Visa Regional Center the requirements are not the same. You don’t have to have family here or set up a business. The requirements would be that you and all family members are in good health with no mental problems or contagious diseases, criminal record or background problems, and no immigration problems. You must also meet the financial capital for the project and have a stable financial background for the past five years. What is direct investment on EB5? The direct investment needs to be at least $500,000, and invested in an area where unemployment of 150 percent of the national average rate has been experienced, or a rural area in need of improvements.
EB 5 Visa Regional Centers promote financial growth, and create jobs through both private and public involvement. The Regional Center accepts the immigrant investor’s capital and establishes the area in which improvements are needed the most. This will insure that financial growth will be placed in areas most deprived of employment. The Regional Centers have the business plan and know the market conditions, project costs and timelines for improvements.
